Perhaps most troubling is the indemnification obligations imposed on suppliers by some suppliers. It is not uncommon for suppliers to require suppliers to be released from third-party claims against the supplier because of the supplier-supplier relationship, even if the supplier is guilty. Approval of such a provision could be disastrous for providers whose existing contracts with insurance bodies may exclude such compensation agreements from coverage in the event of a processing error. In other words, if a surgeon agrees to compensate the seller of EHR and he receives damages as a result of this obligation, that surgeon`s insurance company may refuse to cover such damages. Otherwise, the hospital may remain without access to its electronic records for a certain period of time.
